An offender may be convicted of first-degree criminal sexual conduct in violation of Minn. Stat. ? 609.342, subd. 1(g) if he or she intermittently lives with the complainant at the offenders residence, although the offender is neither related to the complainant nor romantically involved with the complainant or the complainants parent. Because a "significant relationship" is an element of this offense, a trial court may not consider the offenders violation of a position of trust or authority when imposing a sentencing departure.
